The information and counseling offered by us is designed to support, clarify and assist in ethical and benevolent choice-making, but responsibility for your actions/inaction, or any results thereof, remains solely with you, and always will.

~ Invoke copyright of its’ materials and ask that you respect that by not plagiarizing, copying or sharing them without permission, full credit, and linking to the site/source of the info.

~ Forbid transmitting any computer viruses, spam, or other unsavory and illegal content or behavior within the boundaries of this site and business.

We may occasionally use information made in  comments, free of charge, to modify, enhance or create services and material, or as recommendations of our services (where applicable- i.e.: Nurture Astrology’s Facebook page’s star rating option).

~Takes no responsibility for whom you share your Nurture Astrology personal consultation recording, and/or written report with, or anything that happens as a result. 

~ Doesn’t guarantee a refund, and consider any such requests on a case-by-case basis, at our discretion, but the rule of thumb is: if a client can honestly look Bella “V. Vid” in the eye and state that they did not receive meaningful value exchange from the service/consultation offered, they may be considered eligible for a partial or full refund, and it’ll be offered to you. This is a case-by-case situation, to protect against being taken-advantage of. Personal integrity, however, is very important to us and will be adhered to!

This website is operated by Bella “V. Vid”  Agronik, via her Astrology service, Nurture Astrology. Throughout the site, the terms “we”, “us” and “our” refer to Bella Agronik and anyone else directly and intentionally legally involved with Nurture Astrology. Nurture Astrology offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is available via WooCommerce, a plugin offered as part of WordPress.  It is the online e-commerce platform that allows us to sell our products and services to you. Additionally, services can be paid-for directly to Bella “V. Vid” Agronik via E-transfer or Paypal, to her personal accounts.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time, but choose never to do so based on gender, orientation, race, ethnicity, nationality or other unethical basis .

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks (ie: e-mail, chart-generating software, anonymous mention on Astrology forums etc) ; and (b) changes to conform and adapt to technical requirements of connecting networks or devices (if ever applicable).
Credit card information is always encrypted during transfer over networks, and is handled by the PayPal, E-transfer or WooCommerce method of payment chosen by the client, and not directly by Nurture Astrology and Bella “V. Vid” Agronik, at this time. No responsibility is taken by this site, business, and its’ owner, for any issue with those external methods of payment and their terms, policies and conditions, and any charges or issues that may result therefrom . Nurture Astrology and all involved with it will NEVER sell your information or intentionally transfer your information to a third party.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete or current (though every effort is made to make it so). We reserve the right to limit the quantities of any products or services that we offer. We aim for full customer satisfaction in every case, but do not warrant that the results that may be obtained from the use of the service will meet all your expectations in terms of accuracy, detail, or reliability. We will not tell you what you want to hear, and the information offered by us (whether in articles intended for general public, or personal consultation shared during a private consultation) will be offered based on our understanding of Astrological symbology as pertaining to human and collective experience. It may at times not cover information in full, and may, for a wide variety of reasons, not pertain to an individual, group, nation etc as much as to others. We take no responsibility for such situations (though disclaimers will always be attempted to be made as fully as possible). 

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, result, information,  title, and non-infringement.

In no case shall Nurture Astrology, and any (past, present, or future) directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Nurture Astrology and our founder, parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Toronto, Ontario, Canada, and any other city, Province or Country in which Nurture Astrology may temporarily be residing while offering said services.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20: DEPOSIT, COMPLETION OF PAYMENT, AND REFUND POLICY

Due to the time required to prepare for each Nurture Astrology consultation prior to the consultation taking place, we reserve the right to require a deposit (typically 50% of full service), or full pre-payment for the service about to be received (typically, but not limited to, when service is offered in written report format), either at the time of requesting the service, or up to 2 days prior to the service exchange.

The choice of deposit (and its’ amount), or full pre-payment is at the sole discretion of the service provider and will be communicated to the client (or potential client) upon confirmation of the booking. A personal appointment/consultation will not be considered fully scheduled until the deposit or pre-payment are complete, and confirmation thereof is received by the service provider. No service exchange will be required, nor do we take any responsibility for, or any issue resulting from, the assumption of an appointment as being fully booked, without said deposit or pre-payment being completed.
We occasionally reserve the right to waive the need for a deposit or pre-payment, at our sole discretion and for any reason, on a case-by-case basis.

In the case that a client, or potential client, should miss their appointment, for any reason, they waive their deposit amount and are not eligible for a refund thereof. They may, in such a case, reschedule their appointment, at the discretion of the service provider’s availability. If the appointment being rescheduled has not been fully pre-paid at that time, we may request that it is, in order to hold the appointment spot.
In the event that the appointment is missed a second time, without cause deemed appropriate by us, we reserve the right to consider the appointment canceled, and all payment forfeit, to compensate for the loss of 2 appointment times having been kept reserved. We may choose, for any reason, to waive this part of the terms, on a case-by-case basis, but will not be held liable for any inconsistency in doing so.

Because the service offered by us is fully personalized and unique, our refund policy is highly  conditional, is considered on a case-by-case basis, and is based on integrity rather than guarantees. Considering all terms and conditions covered in this document, and having no liability or obligation to offer refunds – either in full or in part – for any reason, we nevertheless welcome a request for such.
After completion of an appointment/consultation or receiving of service, if a client is not fully satisfied with their consultation or the information encompassed therein, they may request a partial or full refund.
Such requests will be considered on a case-by-case basis, and while Nurture Astrology is not obligated to agree to a refund of any sort, we may choose to do so to enhance customer satisfaction and adhere to personal codes of ethics and integrity.  

SECTION 21 – WRITTEN REPORT TERMS

In the case that a written report is requested as the information-delivery method of a personal consultation, it will be sent to the client’s primary communication choice (e-mail, Facebook messaging or other), either via OpenOffice file format, directly in text form within the chosen communication option, or in another format, as requested by the client. We take no responsibility for the terms, availability, or accessibility of the chosen communication-delivery method, or the clients’ ability to retrieve the written report therefrom.
Upon request, we can send the written report to a secondary communication source, or in another format. We will not be held responsible for the clients’ inability to access this secondary source, currently, or in future.
It is the client’s responsibility to save their written report in a location convenient, and reasonably secure, to them. Nurture Astrology is not obligated to keep, or make available, a previously purchased written report, for any length of time after its’ original relaying to the client. In some cases, if a copy remains kept by Nurture Astrology, and is requested by the client upon loss of the original file or printout, Nurture Astrology may, but is not obligated to oblige this request. No guarantee is made that, in such a case, the written report sent a second time is still relevant, or is exactly unchanged from the copy sent originally.

SECTION 22 – SHARING OF CONSULTATION RECORDINGS

The client may choose to share their written report, or any recording or notes taken of their personal reading, with anyone they choose, for the purpose of personal use only. They may do so while giving reasonable credit to Nurture Astrology and Bella “V. Vid” Agronik for the source of the info. They may not infringe on the copyright held thereby, by modifying, plagiarizing, or claiming authorship of the material by anyone other than us.

They are forbidden from sharing any of the aforementioned within a professional or educational context where any profit is incurred, including Astrology classes, professionally-written material, or the selling of the aforementioned to any 3rd party that may use them for profit-making of any kind.

In the occasional instance that a personal consultation recording may include a personal or anonymous anecdote by Bella “V. Vid” Agronik, for the purpose of illustrating or clarifying a point relevant to the reading, or any other reason, such anecdotes or examples are expressly forbidden from being published, used, sold, or in any way made available to the public, press, on a public website, blog etc. No personal information about Bella “V. Vid” Agronik may ever be used for any form of profit-making, directly or via a third party.

We will not be held liable for any 3rd party (ie. hacker, spouse, parent, child, sibling, roommate, employer, colleague, classmate  etc.) gaining access to the information relayed by the written report (with or without the client’s consent or permission), recording of a consultation, notes taken during a consultation, or any correspondence to or from Nurture Astrology, or any complications or liabilities resulting therefrom.
